Terms and Conditions

These Terms and Conditions govern services supplied by Kemetova LLC (شركة كيميتوفا للتسويق الإلكتروني و تصميم المواقع الإلكترونية ش.ذ.م.م), based at 84th Prince Talal St., Al Ahyaa District, Hurghada, Red Sea, Egypt.

By signing a contract, accepting a quotation, paying an invoice or ordering a service from Kemetova, the client agrees to the terms that apply to that service.

Where a signed contract or approved written scope contains terms that differ from this page, the signed contract or approved scope will apply to that project.

Nothing in these Terms and Conditions removes any right that cannot lawfully be excluded under applicable Egyptian law.

1. Kemetova Services

Kemetova provides digital and technical services that may include:

  • Web application development
  • Laravel development
  • WordPress development
  • Website design
  • Mobile application development using React Native
  • Web hosting and related technical services
  • Website maintenance
  • SEO audits
  • SEO content strategy
  • Page speed optimization
  • Social media management
  • Multilingual content and campaign management

Other services may be stated in a signed contract, quotation or approved scope. The exact work for each client is defined by the relevant contract, quotation, proposal, invoice or written scope.

2. Project Scope

Kemetova will carry out the work described in the agreed project scope.

The client is responsible for checking the scope before approving it. Work that is not included in the approved scope may require a separate quotation, change request or additional fee.

A request made during a project does not automatically become part of the agreed scope.

Where a project uses a third-party platform, service, API, plugin, theme, licence or account, that third party may apply its own terms.

3. Project Start and Payment

Project schedules and delivery timelines begin only after the required initial payment, down payment or monthly retainer has been received successfully.

A verbal agreement, enquiry or unsigned quotation does not start the project schedule except where Kemetova confirms otherwise in writing.

Where a contract contains staged payments, the client must make each payment according to the agreed schedule.

Kemetova may pause work where a payment due under the contract has not been received.

4. Third-Party Costs

Kemetova service fees do not include third-party costs except where the contract clearly states that they are included.

Third-party costs may include:

  • Social media advertising budgets
  • Domain registration and renewal fees
  • Hosting renewals
  • Paid plugins or themes
  • Software licences
  • API charges
  • App store fees
  • Payment gateway charges
  • Stock media or licensed assets
  • Other external service charges

Third-party services remain subject to the prices, rules and terms of their providers.

5. Client Content and Materials

The client is responsible for supplying the content, media, information, account access and approvals needed for the project.

This may include text, images, videos, logos, product information, property details, prices, legal wording, translations and other materials.

The client confirms that it has the right to provide these materials to Kemetova and to ask Kemetova to publish or use them.

The client accepts legal responsibility for copyright, trademark, privacy or other rights issues that arise from material supplied by the client.

Kemetova is not responsible for a legal violation caused by client-provided content where the client did not hold the required rights or permission.

6. Client Delays

The client must provide requested content, media, information, access and feedback within the time needed to keep the project moving.

If the client delays the required material, approval or feedback for more than 10 working days, Kemetova will not be responsible for the resulting project delay.

After notifying the client of the delay, Kemetova may invoice the remaining contract balance within 5 working days where the 10-working-day delay condition has been met.

Any original project dates may need to be rescheduled based on team availability when the client becomes ready to continue.

7. Pausing a Project

A client may ask to pause project development by sending an official email to Kemetova.

Where the project is paused before the 10-working-day delay condition has been breached, payment obligations linked to the paused development period will be paused until the restart date stated in the written notice or later agreed in writing.

A pause does not cancel third-party costs that have already been ordered or committed.

If the 10-working-day client delay condition has already been met before the pause request, the delay and invoicing terms in Section 6 will continue to apply.

8. Project Feedback and Approvals

The client is responsible for reviewing work sent for approval and giving clear feedback.

Approval may be recorded by email, an agreed project system or another written communication method used by both parties.

Once an item has been approved, later changes may fall outside the agreed scope and may require extra work or a separate quotation.

9. Project Completion and Handover

A project is ready for handover after the agreed work has been completed, the client has given final approval and all amounts due for the project have been paid in full.

After final approval and final payment, Kemetova will upload or transfer the agreed project files and database to the live server within 2 working days.

The handover may depend on the client providing valid access to the destination server, domain account or other required system.

A delay caused by missing or incorrect client access does not count as a Kemetova handover delay.

10. Ownership After Final Payment

Once a web project has been paid in full and delivered, the client holds 100% ownership of the delivered website, its project files and its database, subject to third-party software, licences and services that remain governed by their own terms.

Ownership transfer does not remove any attribution requirement that forms part of the signed development contract.

Client-provided images, videos, logos and brand assets remain the client's property or the property of their lawful owner.

11. Confidentiality

Kemetova applies a strict confidentiality policy to client projects.

Website files, databases, client information, project information, visitor statistics, reports and other confidential material will not be sold or disclosed to unrelated third parties.

Information may be shared with the contracted client, people authorised by that client, or a service provider that must process limited information to deliver an agreed service.

Kemetova may disclose information where required by applicable law, a court order or a lawful request from a competent authority.

12. Portfolio Rights

Kemetova may display a completed project in its company portfolio in line with the relevant contract.

Portfolio use does not give Kemetova the right to publish private databases, confidential customer records, private analytics reports or client assets that require separate permission.

Where a contract limits or changes portfolio use, that contract will apply.

13. Kemetova Development Credit

For web development projects, Kemetova may place a “Developed by Kemetova” credit and backlink in the website footer as required by the development contract.

Where this requirement is included in the contract, the client may not remove, alter, hide or disable the credit or backlink without Kemetova's written approval.

The client's ownership of the delivered website remains subject to this agreed attribution condition.

14. Technical Support for Hosting Contracts

Where a contract includes Kemetova hosting, Kemetova provides technical support, maintenance and issue handling within the scope of that contract.

The maximum response time is 1 working day.

The response time is the time within which Kemetova will acknowledge or begin handling the reported issue. The time required to resolve an issue may depend on its cause, severity, third-party systems, client access and the work needed.

Issues outside the hosting contract may require a separate quotation.

15. Third-Party Platforms

Some Kemetova services depend on third-party platforms such as search engines, social networks, app stores, hosting infrastructure, payment providers, domain registries or external APIs.

Kemetova does not control the policies, review decisions, service availability, pricing or technical changes made by those third parties.

Where a third-party decision affects a client project, Kemetova can review the effect and discuss any work required to adapt the project.

16. SEO, Advertising and Platform Results

Kemetova carries out the SEO, social media, advertising or related work stated in the agreed scope.

Search rankings, advertising delivery, audience behaviour, lead volume, sales, app store approval and third-party platform decisions are not controlled solely by Kemetova.

Except where a signed contract expressly states otherwise, Kemetova does not guarantee a specific search position, number of followers, number of leads, sales figure or third-party approval.

17. Pricing Changes

Kemetova may review service pricing from time to time to reflect changes in operating costs and national inflation.

For ongoing or recurring services, clients will be notified of a price change before the new rate applies.

The client may accept the new rate or end the affected service at the end of the current prepaid billing cycle.

A new rate does not change a fixed project price already agreed in a signed contract except where both parties agree to the change in writing.

Refund Policy

18. Refund Policy for Web Development Projects

Down payments for web development projects become non-refundable after 3 working days from the contract date.

A refund request made within the first 3 working days will be handled according to the signed contract and any mandatory legal rights that apply.

After the 3-working-day period has passed, the web development down payment is non-refundable, subject to any right that cannot lawfully be excluded.

This policy reflects the allocation of project time, planning and development resources after a project has been accepted.

19. Refund Policy for Social Media Management

Monthly retainers paid for Social Media Management are non-refundable.

Once a prepaid monthly billing period has started, cancellation does not create a refund for that billing period, subject to any mandatory legal right that applies.

Kemetova will continue the agreed service until the end of the current prepaid billing cycle except where the parties agree otherwise in writing.

20. Refunds for Other Services

Refund terms for services not covered in Sections 18 and 19 are governed by the applicable contract, quotation, order terms and mandatory law.

Third-party charges remain subject to the terms of the relevant third-party provider.

Nothing on this page removes a statutory consumer right that cannot legally be waived.

Cancellation Policy

21. Cancellation of Monthly Services

Clients may cancel a monthly service at any time by giving Kemetova written notice.

The service will continue until the end of the current prepaid billing cycle.

The cancellation prevents the next billing cycle from starting, provided notice has been received before that cycle is due.

Amounts already paid remain subject to the refund rules for the relevant service.

22. Cancellation of Project Work

Where a client decides not to continue a fixed project, the refund rules in the applicable contract and Section 18 will apply.

The client should send the cancellation request by official email.

Kemetova will confirm the project status, payments received, any applicable non-refundable amount and the position of work already completed.

Where the contract contains additional cancellation terms, those terms will apply.

23. Service Renewal

Recurring services continue according to the billing period and renewal terms stated in the contract or invoice.

Third-party renewals, including domains and hosting services, are not included in Kemetova service fees except where the applicable contract or invoice states otherwise.

The client is responsible for paying renewal amounts by the relevant due date where the renewal is required to keep a service active.

24. Client Accounts and Access

The client must keep account credentials secure and provide Kemetova with the access reasonably needed to perform the agreed work.

The client should notify Kemetova when access has changed or been revoked.

Kemetova is not responsible for delays caused by missing, incorrect or expired access supplied by the client.

Access supplied to Kemetova is handled in line with the Kemetova Privacy Policy and confidentiality obligations.

25. Governing Law and Jurisdiction

These Terms and Conditions and the services supplied under them are governed by the laws of the Arab Republic of Egypt.

Subject to any mandatory rule of law that provides otherwise, disputes arising from the execution or interpretation of the contract will fall under the exclusive jurisdiction of the Red Sea Primary Court (محكمة البحر الأحمر الابتدائية).

Nothing in this clause prevents a consumer from exercising a mandatory right or complaint process available under applicable Egyptian law.

26. Changes to These Terms

Kemetova may update these public Terms and Conditions when its services, operating procedures or legal requirements change.

Changes to this public page do not retrospectively replace specific terms already agreed in a signed client contract except where the parties agree otherwise or applicable law requires the change.

The latest revision date will be shown at the top of the page.
